			<content:encoded><![CDATA[<p>Montana has a law on the books to manage noxious weeds. An excerpt from the law: “It is unlawful for any person to permit any noxious weed to propagate or go to seed on the person&#8217;s land, except that any person who adheres to the noxious weed management program of the person&#8217;s weed management district or who has entered into and is in compliance with a noxious weed management agreement is considered to be in compliance with this section.”</p>

			<content:encoded><![CDATA[<p>In 2010 the Montana Department of Agriculture revamped the noxious weed priority system.   Noxious weeds are now rank one of 5 priorities.</p>
<p><strong>Priority 1A </strong>- These weeds are not present in Montana.  Management criteria will require eradication of detected; education and prevention.</p>
<p><strong>Priority 1B</strong> &#8211; These weeds are have limited presence in Montana.  Management criteria will require eradication or containment and education.</p>
<p><strong>Priority 2A</strong> &#8211; These weeds are common in isolated areas of Montana.   Management criteria will required eradication or containment where less abundant.  Management shall be prioritized by local weed districts.</p>
<p><strong>Priority 2B</strong> &#8211; These weeds are abundant in Montana and widespread in many counties.   Management criteria will require eradication or containment where less abundant.  Management shall be prioritized by local weed districts.</p>
<p><strong>Priority 3</strong> &#8211; Regulated Plants &#8211; NOT Montana Listed Noxious Weeds.  These regulated plants have the potential to have significant negative impacts.  These plants may not be intentionally spread or sold other than as a contaminant in agricultural products.  the state recommends research, education and prevention to minimize the spread of the regulated plant.</p>

			<content:encoded><![CDATA[<p>We have a copy of the newest <a href="http://www.mtweed.org/library/wp-content/uploads/2010/02/2010-weed-list.pdf">Montana Noxious Weed List </a> and a <a href="http://www.mtweed.org/library/wp-content/uploads/2010/02/2010-weed-brief.pdf">weed brief</a>, explaining the Priorities and the reason for the change.  You will notice that Russian olive is not listed as the Department of Ag will be sending a survey to the County Commissioners in each county requesting where they feel it should be listed if at all.  The letter will be coming from the Director of the Department of Agriculture and should be sent out in the near future.  Please include this list in your management plans.</p>

			<content:encoded><![CDATA[<p>Montana is the only states in the nation to offer grants through a noxious weed trust fund administered by the Department of Agriculture. The fund was established in 1985 with a $2.5 million cap. The interest off of this fund the vehicle license fee is what generates grant funding. Recently at the 2007 legislature, HB 269 increased the Trust and capped it at $10 million. The estimated interest off of this fund in 2008 is $409,000 and will be used for direct on the ground local cooperative, educational, and research projects. Grant deadlines are the first of December, with hearings held in March of the following year.
